WCBOE Violates Citizen's Rights and Bans Him From Future Meetings

A citizen showed up to the Wicomico County BOE meeting on June 13, 2023 to express his First Amendment right to redress his grievances before his county government over their absolute integration of discriminatory CRT ideology that is critical of race, religion, discriminatory hiring practices, disproportionate discipline by race, and defining divisive social classes, while establishing a system of sexual and gender identity indoctrination throughout Wicomico County Public Schools (links contain actual exhibits of CRT ideology found in the school system). Some people didn't like what the citizen had to say, so they had him removed by an officer and sent him a letter on June 23rd reprimanding him for violating board policy and banning him from returning to a future board meeting.


Here is the letter sent to the citizen reprimanding him and banning him from future meetings.



The Public Comments Protocol Policy was created just weeks after the DPTC first exposed the use of sexually explicit materials in the school. The WCBOE did not like the exposure, so the prior school board wrote this abusive policy designed to obstruct the citizens and violate their First Amendment rights. Since its creation, even more CRT ideology and obscene materials have entered the school system, while further circumventing process and accountability. This public comment policy was crafted to prohibit a citizen from displaying or holding up a poster, sign, book, class assignment, or video, and regulates a citizen's volume, tone, language, actions, and demeanor. The policy also demands respectful acknowledgement for individual differences, diversity, personal, civil, and property rights of others, while the board and its administration are exempt from such.


Gene Malone, board Chair and the Superintendent drafted the letter. Legally, the board can only act as a corporate body, and no individual board member has any authority to take official action on behalf of the board. The board Chair can act as a spokesperson for the board, but his or her position must be of the majority. Either way, such an unauthorized action against a citizen would have no legal force or effect, and would not be legal if they did. The letter to bully the citizen was sent out on board letterhead with all members listed at the top. They are all liable for these civil abuses.


There was absolutely no purpose in sending such a letter ten days after the meeting, other than to harass and intimidate a citizen. Who made Gene Malone arbitrator, judge and jury of the First Amendment? Gene Malone should resign immediately not only as Chair, but his seat. This would also call for the resignation of Superintendent Micah Stauffer who ordered the letter to be drafted. You can contact the board members below and ask them to abolish this abusive Public Comments Protocol Policy that the majority of the newly elected members vowed to get rid of during their campaigns. You can let them know how you feel about the mistreatment of citizens they are supposed to represent.
